New Commuter Referral Promotion

Official Rules

1. ELIGIBILITY: The New Commuter Referral Promotion is only open to current Commute with Enterprise participants.
2. TIMING: 1/1/2021 - 6/30/2022
3. SPONSOR: Your local Commute with Enterprise Group
4. HOW IT WORKS: When a current Commute with Enterprise customer refers a new commuter group AND the vehicle is delivered, the Referring Party will receive a $200 Gift Card* (the “Gift Card”).
5. TERMS & CONDITIONS:

• A new commuter group must be made up of passengers who are not currently customers of Commute with Enterprise.
• The referral must be for a new group of 5+ participants who are ready to start commuting with Enterprise. A referral cannot be generated for a group who has already contacted Enterprise.
• The new commuter group must have a Coordinator and at least one Approved Driver.
• The gift card will be delivered to the Referring Party upon delivery of the new commuter vehicle.
• The Referring Party’s account must be current in order to receive the gift card.
• Promotion void where prohibited by law, Agency/Employer policies or Commute with Enterprise contract.

LIMITATIONS OF LIABILITY AND RELEASE:  BY PARTICIPATING IN THIS PROMOTION, ENTRANTS AGREE TO RELEASE, HOLD HARMLESS AND INDEMNIFY SPONSOR, ITS PARENT AND SUBSIDIARY COMPANIES, AFFILIATES, DIVISIONS, FRANCHISEES, CONSULTANTS, SUB-CONTRACTORS, SUPPLIERS, DISTRIBUTORS, LEGAL COUNSEL, ADVERTISING, PROMOTION, FULFILLMENT, MARKETING AND PUBLIC RELATIONS AGENCIES, AND INDEPENDENT CONTRACTORS, AND THE RESPECTIVE SHAREHOLDERS, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, REPRESENTATIVES, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, AND AGENTS OF EACH (COLLECTIVELY, "RELEASED PARTIES") FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, INJURIES, LOSSES, LIABILITY, OR DAMAGES OF ANY KIND, INCLUDING LEGAL FEES, ARISING OUT OF PARTICIPATION IN THIS PROMOTION, WHILE PREPARING FOR, PARTICIPATING IN AND/OR TRAVELLING TO OR FROM ANY REWARD- OR PROMOTION-RELATED ACTIVITY, OR DELIVERY, POSSESSION, AWARDING, MISDELIVERY, ACCEPTANCE, USE, MISUSE OR INABILITY TO USE OR REDEEM THE REWARD (INCLUDING, WITHOUT LIMITATION, CLAIMS COSTS, INJURIES, LOSSES AND DAMAGES RELATED TO PERSONAL INJURIES, DEATH, LOSS, DAMAGE, ACCIDENT, OR DESTRUCTION TO OR OF PERSON OR PROPERTY, RIGHTS OF PUBLICITY OR PRIVACY, DEFAMATION OR PORTRAYAL IN A FALSE LIGHT, WHETHER INTENTIONAL OR UNINTENTIONAL). The foregoing release is void where prohibited by law.

Released Parties are not responsible for any misprints, typographical or other error in these Official Rules, in any Promotion-related advertisements or other materials, or the printing, the offering or the announcement of any reward or in the administration of the Promotion.  The Released Parties are not responsible for late, lost, damaged, misdirected, incomplete, illegible, stolen or destroyed referral forms submitted to or by a Sponsor representative or through the postal service, or for technical failures or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of referral forms will not be deemed proof of receipt by Sponsor. The Released Parties are not responsible if any reward cannot be awarded due to acts of God, acts of war, natural disasters, weather, or terrorism. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

GENERAL: Sponsor may prohibit an entrant from participating in the Promotion, or from earning a reward if, in its sole discretion, Sponsor determines that said entrant is attempting to undermine the legitimate operation of the Promotion by cheating, deception or other unfair playing practices, or intending to annoy, abuse, threaten or harass any other entrants, Sponsor’s representatives. Referral forms are void if not obtained through authorized, legitimate channels, or if any part is defective, altered, duplicated, photocopied, forged, counterfeited, mutilated or tampered with in any way, or if referral forms contain or are the result of printing, seeding, typographical, mechanical or other errors. Sole liability for an irregular official referral form is limited to replacement with a free official referral form.

By participating in this Promotion, participants agree to be bound by these Official Rules and by the decisions of the Sponsor, and further waive any right to claim ambiguity in this Promotion or these Official Rules. The Promotion Entities expressly disclaim any express or implied warranties in connection with the rewards.

No correspondence will be entered into except with the eligible recipients. Except where prohibited by law, accepting a reward constitutes permission for the Promotion Entities (which permission will be confirmed in writing on request of Sponsor), and any of their designees, to print, publish, broadcast, and use recipient’s name, portrait, picture, likeness, statements, biographical information, voice, and address (city/Missouri) worldwide and in all forms of media now known or hereafter developed, including but not limited to the World Wide Web, in perpetuity, for advertising, trade, and promotional purposes, without further review, approval, notice or compensation.

PRIVACY:  By entering this Promotion, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering the Promotion and in accordance with Sponsor’s privacy policy, which can be found at https://privacy.ehi.com/en-us/home.html.

GOVERNING LAW/DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any reward awarded shall be resolved individually, without resort to any form of class action, and exclusively by the federal or state courts located in Missouri; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Missouri, without giving effect to any choice of law or conflict of law rules (whether of the State of Missouri or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Missouri.  

* The Gift Cards are issued by a third party and Sponsor does not have control over any fees, expiration dates, or similar restrictions imposed on such Gift Cards by the applicable issuer or for the applicable issuer’s compliance with applicable laws, including the Card Accountability, Responsibility, and Disclosure Act of 2009. Unless authorized by Sponsor, each Gift Card must be accepted as awarded. The Gift Cards may not be transferred, substituted or redeemed for cash, except at Sponsor’s sole discretion, and Sponsor reserves the right to substitute the Gift Card or a component thereof with a reward of equal or greater monetary value whether cash or otherwise. If the actual value of a Gift Card is less than the stated ARV, the difference will not be awarded. Any depiction of a Gift Card is for illustrative purposes only. Sponsor will not replace any lost or stolen rewards or components of a reward(s). Reward recipient is solely responsible for the reporting and payment of any income tax relating to the reward, as well as any other applicable federal, state, and local taxes, fees and expenses related to acceptance and use of the reward not specifically stated herein. SPONSOR EXPRESSLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES AND THE RECIPIENT AGREES THAT THE REWARD IS PROVIDED “AS IS” AND WITHOUT ANY EXPRESS OR IMPLIED WARRANTY, REPRESENTATION, OR GUARANTEE OF ANY KIND.
